Bair Hilty is actively involved in representing general contractors, subcontractors, architects, and other parties in construction litigation.  Among its clients are national, regional, and local home builders.  Bair Hilty is also approved counsel for various insurance carriers who insure and defend contractors, subcontractors, architects, and others in construction litigation.  The firm has handled numerous cases governed by the Texas Residential Construction Liability Act, including lawsuits alleging foundation failure, code violations, electrical defects, heating and air conditioning deficiencies, water damage, and mold infestation.

The firm also has a long history of representing clients in commercial construction.  These clients include regional and local roofing contractors.  The firm also represents construction companies in perfecting Mechanics Liens on both residential and commercial properties.

Bair Hilty also represents builders and their insurance carriers in subrogation actions arising out of fire losses.  The firm has successfully handled cases involving claims of spontaneous combustion and improper welding techniques.  The firm has also been retained by various insurance carriers to represent their insureds, including apartment complexes, builders, and  other defendants involved in litigation arising out of alleged mold infestation and resulting injuries and damages.

The firm's lawyers are experienced in representing contractors and subcontractors in litigation arising out of remodeling, reconstruction, and remediation work.

The firm is also actively involved in representing contractors and subcontractors in personal injury litigation arising out of accidents on the construction site.

The firm is also involved in representing builders and contractors in arbitration and has successfully enforced arbitration clauses in construction contracts.
